These Terms and Conditions (“Terms”) govern your use of the myCloudDrive Mac application (“App”). By downloading, installing, activating, or using the App, you agree to be bound by these Terms.

1. Service Description

The App is a macOS desktop application designed to provide cloud storage management and file synchronization functionality. It enables users to connect to supported cloud services, manage files, and synchronize data directly from their Mac.

The App is installed locally on your Mac device and may require system permissions such as file access, network access, or background processing permissions. A valid license key may be required for activation.

2. Eligibility

To use the App, you must:

• Be at least 18 years old;
• Have the legal right to use the Mac device on which the App is installed;
• Agree to these Terms.

3. License and Pricing

The App is offered under a paid license model. Pricing may be available on a monthly or yearly basis, as listed on the myCloudDrive website at the time of purchase (VAT included where applicable).

By purchasing a license, you obtain the right to use the App for the duration of the selected billing period (monthly or yearly). When the billing period ends, the license expires automatically.

Licenses do not renew automatically. You must manually purchase a new license if you wish to continue using the App after expiration.

All payments are final. No refunds are provided after purchase unless required by applicable law.

4. User Responsibilities

You are solely responsible for:

• Managing and securing your Mac device;
• Ensuring correct installation and configuration of the App;
• Backing up your data and files;
• Compliance with all applicable laws, including privacy, copyright, and data protection laws;
• Ensuring that the App is used only for lawful purposes.

5. No Warranty / Disclaimer

The App is provided “as is” and “as available”. myCloudDrive makes no warranties of any kind, including but not limited to:

• Continuous availability or uninterrupted synchronization;
• Performance, speed, or compatibility with all macOS versions or third-party cloud services;
• Fitness for a particular purpose;
• Security or immunity from unauthorized access or data loss.

You install and use the App at your own risk.

6. Limitation of Liability

To the maximum extent permitted by law, myCloudDrive and its owner are not liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the App. This includes, but is not limited to, loss of data, revenue, or business.

Total liability is limited to the amount paid for the license during the preceding 12 months.

7. Termination

You may stop using the App at any time; however, no refunds will be issued.

myCloudDrive may suspend or terminate your license if you violate these Terms or use the App unlawfully. Upon termination, the license may be invalidated or disabled.

8. Intellectual Property

All rights to the App, including code, documentation, branding, and associated materials, remain the property of myCloudDrive and its owner. You retain all rights to your own files and data.

9. Legal Compliance

You are responsible for ensuring that your use of the App complies with all applicable laws and regulations relevant to your jurisdiction.

10. Changes to Terms

myCloudDrive may update these Terms at any time. Updated Terms will be made available on the myCloudDrive website. Continued use of the App constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by German law. Any disputes shall be resolved in the courts of Düsseldorf, Germany.
